The Senate has said that it is not in a hurry to pass the 2018 Budget, but will be painstaking in carefully scrutinizing every aspect of the budget proposal to ensure that the right thing is done. The Senate Committee Chairman on Local and Foreign Loans, Senator Shehu Sani, disclosed this on Thursday during a courtesy visit to The Daily Times corporate office in Abuja. Responding to questions regarding the December 19 deadline set for the passage of the bill, Sen Sani said that the Senate did not set any deadline for the passage of the budget. He said that the Senate was trying to avoid a situation whereby the National Assembly would be blackmailed by the executive arm of the government. According to him, the fact that President Muhammadu Buhari presented the budget, Nigerians expected the National Assembly to pass it. He said, “But doing the right thing is more important than timing; and doing the wrong thing. If you do the wrong thing and meet up with the deadline, you will plan to come back to do it again; so, why the rush? What we are trying to do is to balance up by doing the right thing at the right time. What is about to happen this time around is that we are going to scrutinise every aspect of the budget. “Now, we have gone on Plenary to give every committee the opportunity to sit down and go through all aspects of the budget and interact with the relevant stakeholders to get the details. “We have passed through 2016 and 2017 budgets; and it is a fact that the budget performance within these two years was not good enough; and Nigerians are not happy; and many are angry; and we do not want to be the scapegoat for the failure of 2016 and 2017 budgets. For that very reason, we must do everything possible to ensure that whatever is presented to us is thoroughly treated to address those very issues that were contained in the budget.” Sani, while noting that the performance of the 2016/17 budget has not met the expectations of Nigerians, said that, “We have been left with abandon projects, we have been left with unattended projects, we have also been left with promises and pledges that were made, but we were still not fulfilled. We are of the hope that this time around, we would treat the budget and return it back to the Executive for them to be able to sign it, and then we can move on.” He also said that the Senate would not want to carry “the cross of failure” where they will be blamed for not passing the budget on time. However, he assured that the budget would be passed in good time and will do the right thing, adding that: “We expect the Executive Arm to perform and fulfil their pledges so that they will not set Nigerians against us.”

The National Judicial Council (NJC) under the Chairmanship of the Chief Justice of Nigeria (CJN), Justice Walter Onnoghen, has wielded its big stick as it recommended the compulsory retirement of Justices Adeniyi Ademola and O. O. Tokode of the Federal High Court for compulsory retirement from office for misconduct. The decision was reached during the NJC’s 84th meeting in Abuja on Wednesday The development was disclosed in a statement issued and signed by the NJC’s director of Information, Mr Soji Oye and made available to journalists in Abuja on Thursday. Though Justice Ademola had forwarded his notice of retirement on October 10, 2017 to the NJC against April 9, 2018, when he will attain the mandatory retirement age of 65 years, the Council has recommended him for compulsory retirement from office to President Muhammadu Buhari. The recommendation was in pursuant to the findings by the Council on the allegation contained in the petition written against Justice Ademola by a group of eight persons under the name of Committee of Anambra State PDP House of Representatives Members-Elect alleging His Lordship on the following:- “That His Lordship heard their Suit No. FHC/ABJ/CS/177/2015 which was adjourned for judgement on March 25, 2015; “That on the adjourned date, His Lordship did not deliver the judgement but adjourned the case sine die, to await the decision of the Supreme Court on another matter on the same issue, on the list of PDP candidates for Anambra State for the General Elections of 2015; “That His Lordship speedily heard and delivered judgement in another case in Suit No. FHC/ABJ/CS/254/2015 filed later on the same issues, with intent to confer undue advantage on the Plaintiff who is from a family with which the Respondent has relationship; “That the Certified True Copy (CTC) of the judgement ultimately given to the petitioners contained a paragraph that was not read in open Court by the Hon. Judge and that a phrase was altered, all to address an issue raised in the appeal that had already been filed by the Petitioner before the issuance of Certified True Copy (C T C); “That some of the reasoning and conclusions of the Hon. Judge were summersaults; “That the Respondent finally delivered judgement in the case on 8th July, 2016, five (5) months after the Supreme Court delivered the judgement he was awaiting contrary to the Constitutional provisions that judgements should be delivered within a period of 90 days. “Though the Petitioners withdrew their petitions in accordance with Regulation 16 of the NJC Judicial Discipline Regulations of 9th March, 2017, Council viewed His Lordship’s action of non-delivery of judgement within the stipulated time as misconduct contrary to Section 292 (1) (b) of the 1999 Constitution (as amended) and Rules 1.3 and 3.7 of the 2016 Revised Code of Conduct for Judicial Officers of the Federal Republic of Nigeria. ” The public is hereby informed to disregard news circulating on some news media that Justice Ademola has voluntarily retired. The purported voluntary retirement is clearly an afterthought as the Council had taken action before his decision to forward any voluntary retirement letter.”

Fresh facts have emerged last night about how Justice Adeniyi Ademola of the Federal High Court in Abuja suddenly tendered his letter of resignation from the Bench in order to avert certain action from the National Judicial Council (NJC). The Daily Times also gathered from multiple sources that the judge’s sudden resignation followed a hint that the NJC which met yesterday would consider the report of a committee that recommended his dismissal from the Bench. The NJC later confirmed the hint when it issued a statement on Thursday, recommending Ademola for compulsory retirement. The judge, who had in October this year gave notice of retirement in March 2018 when he will attend the mandatory retirement age, suddenly on Thursday tendered a voluntary retirement letter dated the 6th December 2017 to the Chief Justice of Nigeria (CJN) and Chairman of the NJC, Justice Walter Onnoghen. His letter of resignation simply read, ” I hereby voluntarily retire from the bench of the Federal High Court of Nigeria with effect from 6th December, 2017.” NB : “This letter supersedes my previous notice of retirement from the Federal High Court of Nigeria dated 25/9/2017.” Surprisingly, the judge, who has fixed Thursday to deliver judgement on a suit filed by the Federal Republic of Nigeria (FRN v Abimael & Ors) involving some alleged members of Boko Haram, abandoned the case and dropped his written judgment at the chambers of the Acting Chief Judge of the Federal High Court, Justice Abdul Kafarati . Justice Ademola was said to have stirred the hornets’ nest when he obtained a court order from one of the judges of the Federal High Court in Abuja, restraining the NJC from investigating him on a petition written by a litigant. But the NJC had this year went before the Court of Appeal in Abuja to challenge the order given by Justice John Tsoho of the Federal High Court in Abuja on July 7, restraining it from investigating a petition against Justice Ademola. In its notice of appeal dated August 14, NJC argued that Justice Tsoho erred in law when he barred it from inviting Justice Ademola to answer to allegations contained in a petition that was lodged against him. Justice Tsoho had in the said judgement, stopped NJC from investigating Ademola over the petition that was filed by one Hon. Jenkins Duvie Giane Gwede but was subsequently withdrawn.

A Federal High Court in Lagos, on Thursday, ordered a businessman, Ani Paulinus Onyeka, to forfeit $700,000 out of the $1, 909,140 he allegedly laundered to the Federal Government. The Economic and Financial Crimes Commission (EFCC) had accused Onyeka of laundering $1, 909, 140, but, he entered a plea bargain arrangement with the agency. Justice Rilwan Aikawa had on October 25, ordered Onyeka’s arrest for refusing to show up in court to answer to a money laundering charge slammed on him by the anti-graft agency. The EFCC had filed a two count-charge marked, FHC/L/161c/2014, against the businessman over his failure to declare $1, 909,140, which he allegedly laundered from the Republic of Congo to the men of the Nigerian Customs Service (NCS). But, when the matter came up on Thursday, the accused person owned up to the alleged offence after entering into a plea bargain agreement with the EFCC. The EFCC’s lawyer, Rotimi Oyedepo, said the defendant was handed over to the commission following his arrest on February 23, 2014 with $1, 909,140 at the Murtala Mohammed International Airport by men of the Nigeria Customs Service (NCS). He said the defendant who claimed to be a Congolese, disclosed in his statement that the money was given to him by one, Ikechukwu Frank, for delivery to one, Jude Okoye. The lawyer added that the businessman was arrested by men of the NCS while attempting to deliver the money without going through any financial institution. Oyedepo also displayed a letter from the Central Bank of Nigeria (CBN) showing that the money is in its custody. He also revealed that the commission had signed a plea bargain agreement dated December 4, 2017, with the accused person. He subsequently urged the court to convict the defendant in view of his plea and overwhelming evidences against him. Justice Aikawa ordered that the businessman should forfeit $700, 000 to the Federal Government out of the seized money. A breakdown of the money to be forfeited by the defendant showed that he was given an option of fine of $50, 000 while he is also to forfeit $650, 000 to the Federal Government. According to the judge, the money which is to be paid from the recovered $1, 909,140, that was kept in the safe custody of the Central Bank of Nigeria (CBN) is to be credited to the consolidated fund of the federation.

Nigeria’s Minister of Transport, Rotimi Chibuike Amaechi, on Thursday, met Governor Akinwunmi Ambode of Lagos State for about one hour, at the Lagos House, Alausa, Ikeja. At the end of the meeting, Amaechi declined interaction with journalists for fear of being misquoted. Amaechi, who drove himself in a Black Lexus SUV, with number plate Lagos GGE 315 DN, arrived the Lagos House in Alausa, Ikeja, at about 10.59 a.m. and went straight into a meeting with the governor. At about 11.57 a.m., Amaechi, dressed in a white Niger Delta attire, emerged from the meeting into the waiting hands of the Lagos State Governor’s Office Correspondents, who had arrived the Lagos House about three hours earlier. After being asked for an interview by the waiting journalists, the Minister, accompanied by the Secretary to the State Government, Mr. Tunji Bello, and other state officials declined, saying he was not ready to be misquoted again. As he headed towards the SUV he had driven into the venue, the minister said: “I will not speak, so that you will not misquote me again.” The journalists, who were taken aback by the Minister’s action, wondered where and when he was misquoted. Although there was no official briefing about what was discussed, the menace of articulated vehicles parking on major highways in Lagos metropolis which had continued to defy all efforts at resolution by the state government, it is believed, might have been top on the agenda of discourse.
