Controversy is now trailing the Court of Appeal in Lagos judgment which held that the Economic and Financial Crimes Commission (EFCC), lacks the power to prosecute a serving judge on corruption charges. 

While some some senior lawyers and civil society have lauded the judgment delivered by Justice Obaseki Adejumo JCA, others have condemned the verdict Justice Adejumo on Monday struck out 14 count criminal charges filed by the Economic and Financial Crimes Commission against a judge of the Federal High Court, Justice Hyeladzira Nganjiwa on the ground that the EFCC does not have powers to investigate or prosecute serving judicial officers except where such judicial officers have first been dismissed or retired by the NJC. 

The judgment also stated that serving judicial officers can only be prosecuted for offences like murder, stealing etc if such offences are committed outside the discharge of their official duties; that once the offence is allegedly committed in the discharge of their duties, they must first be tried by the NJC and dismissed or retired before the EFCC can investigate or prosecute them. But, a letter written by the National Judicial Council (NJC),as far back as last year in respect of Justice Nganjiwa and Justices Rita Ajumogobia expressly given permission for their trial. 

In the said NJC letter which also formed the bases of a press statement, the council had informed EFCC and the public that the concerned judges had been directed “not to perform any judicial duties pending the conclusion of their cases.” In essence, the Economic and Financial Crimes Commission (EFCC) was given permission by the National Judicial Council (NJC) to try Justice Hyeladzira Nganjiwa and other judges accused of bribery. 

The letter specifically stated thus: “I have been directed to inform you that Council, at is Meeting which was held on 2nd and 3rd November, 2016 decided that indicted Judicial Officers should not perform Judicial duties until the anticipated cases against them are concluded.”

THE Nigerian Communications Commission, (NCC), yesterday cleared the air making round in some quarters especially from telecommunication consumers/subscribers that the use of ‎mobile phones poses high health risk in the country. South East zonal Controller of the Commission, Emilia Nwokoro made the clarification in Abakaliki during the Consumer Conversation Forum, CCF, held at the secretariat of Abakaliki local government area of the State. According to her, it was necessary for telecom consumers to be educated on their basic rights, quality service and safety and how to seek redress when their rights are abused as NCC places premium on consumers. She said:”The Nigerian Communications Commission (NCC) is an independent National Regulatory Authority for the Telecommunications industry in Nigeria. In line with the 8 point agenda of the Commission, this year 2017 has been declared “NCC Year of the Telecom Consumers” The aim is to ensure that the telecommunications Consumers are carried along in their regulatory function. She however stated that despite frantic effort by NCC to enlighten and educate telecom subscribers, Nigerians are yet to understand and appreciate the role of NCC between Network providers and telecom consumers. She added that no adverse health effects have been established as being caused through the use of mobile phones. “A number of studies have investigated the effects of radiography fields on brain electrical activity, cognitive function, sleep, heart rate and blood pressure in volunteers. To date, research does not suggest any consistent evidence of adverse health effects from exposure to radiofrequency fields at levels below those that casue tissue heating.

The Nigeria Labour Congress (NLC) Cross River State Council has chastised Governor Ben Ayade for paying December Salary on November 30, describing it as deliberate attempt to impoverish workers in the state. Speaking with The Daily Times shortly after the union’s congress in Calabar, Vice Chairman of the Nigeria Labour Congress (NLC), Cross River State Council, Comrade Edim Oyongha, lamented that the Union was not consulted before such decision was taken. Comrade Oyongha said: “In Cross River State, we don’t discuss anything with government, government does not discuss with labour. I don’t see how you pay somebody salary for December in November 30th. As I stand here, I collected salary on November 30th and I don’t have N500 left. “So how are you going to survive December, and then talk of January 2018? For your information, even the salary that you heard have been paid, not everybody has collected. At as I am speaking to you, some people have not collected their November Salary. “Even the December salary, some have not collected, they are people who earned N10, 000 for instance but collected N6, 000. We are in a pity full situation because if we were working with government that does relate with us very well, this confusion would not have occurred”.
