Senior lawyers in the country and their umbrella body, the Nigerian Bar Association (NBA), yesterday waded into the controversy trailing the alteration of election sequence by the National Assembly and subsequent attempt by the federal lawmakers to veto President Muhammadu Buhjari’s refusal to sign the Electoral Act (Amendment) Bill 2018 into law. Specifically, the legal experts insisted that as it stands, the ball is in the court of the judiciary, which has the final say on issues pertaining to provisions of the constitution. Accordingly, they urged the Senate to go on appeal if it is not satisfied with the ruling of a Federal High Court which temporarily barred the National Assembly from overriding the refusal of the president to sign the Electoral Act (Amendment) Bill 2018 into Law. Speaking exclusively to LEADERSHIP on Senate’s resolution to write the Chief Justice of Nigeria (CJN), Justice Walter Onnoghen, and ask him to warn his judges to respect the principle of separation of powers, the NBA and the members of the inner bar said the proper thing for the Red Chamber to do is to go the Court of Appeal to contest the decision of the lower court. The Senate had on March 15, 2018 resolved to petition the National Judicial Council (NJC) over the decision of a Federal High Court to stop the lawmakers from taking any further action on the amended bill, which was rejected by the president. The upper chamber said the judiciary had no power to stop them from carrying out their primary duty of making laws. But disagreeing with Senate’s resolution to write the CJN, the lawyers insisted that no any arm of government, whether the legislative or executive, has the right to disobey the decision of a court of law, and that anything to the contrary will amount to an invitation of anarchy or resort to self-help if that is permitted. Nigeria, they contended, operates constitutional democracy, with the three arms of government given respective defined roles, just as they noted that it is the duty of the judiciary to pronounce on validity of any law enacted in the country. The NBA argued that whoever is not satisfied with the pronouncement of the court of law on such validity is left to go ahead to contest it, saying writing the CJN to caution the judges on what to pronounce upon or not is not proper for the legislators President of the NBA, Abubakar B. Mahmud (SAN), told our correspondent that the Senate was wrong to have questioned the authority of the judiciary to halt the plan by the National Assembly to proceed with the Electoral Act (Amendment) bill 2018. He urged the Senate to be mindful of the fact that if the executive refuses to implement laws made by the National Assembly, the legislature can do nothing but run to the judiciary. Asking the lawmakers to be careful of their utterances, the NBA president averred that neither the judge who granted the order nor the lawyer who applied for the order committed any act of misconduct.

For Nigeria to remain competitive in the current era of low global oil price, the Petroleum Industry Governance Bill (PIGB) recently passed by the National Assembly must address the issue of production cost in the nation’s oil and gas sector to allow for competition in the global market. The minister of state for petroleum resources, Dr Ibe Kachikwu, stated this while speaking at a symposium on the next step for the PIGB organised by Nigeria Extractive Industry Transparency Initiative (NEITI) in Abuja yesterday. Kachikwu stated that Nigeria currently operates one of the highest costs of extraction among oil provinces in the world. “The message is becoming clearer that we have to reduce the cost of production if the country is to be competitive in the modern low oil price world. “Now is the time to tweak the existing industry laws and come up with a new legal, institutional and commercial framework that will liberalise the petroleum industry as well as create a competitive business environment that will enhance Nigeria’s revenue,” he said. Kachikwu, who was represented by Engr. Johnson Adeyemi, senior technical assistant to the minister, stated that the time had come to address the institutional, fiscal and regulatory uncertainties bedevilling the sector so as to bring to an end the declining foreign investment in Nigeria’s hydrocarbon projects. According to him, Nigeria needs to take measures to safeguard its future in the light of its former trade partners seeking alternatives to oil for their energy needs. “With North America becoming more energy self-reliant, Europe has the technology with regards to alternative energy and China maintains a grip on the natural resources of the entire African flank, in addition to the search for oil and gas through fracturing at the home front. “Our window of opportunity to benefit maximally from the petroleum industry is narrowing. It’s clear that the shale oil revolution is gradually changing the geopolitics of oil, with ripple effects likely to linger on for years which could have a serious global implication if we don’t put our house in order,” he stated. In his welcome address, the executive secretary of NEITI, Waziri Adio, highlighted the importance of deliberating about, and triggering actions on, the legal and institutional framework for adequate optimisation of the nation’s oil and gas sector.

President Muhammadu Buhari has given marching orders to Agencies, Corporations and government owned companies, saying they have till Friday March 23 to submit details of their 2018 budget estimates to the appropriate committees of the National Assembly. The Secretary to the Government of the Federation (SGF), Boss Mustapha, disclosed this in a circular conveying the directive to all Ministries, Departments and Agencies (MDAs). The SGF directed the agencies to comply with the provisions of the law and honour invitations to defend their estimates timeously. According to a statement from the media office of the SGF, Mustapha enjoined supervising Ministers to ensure timely compliance with the content of the Circular. The statement made available to LEADERSHIP yesterday reads: “It has come to the attention of government that a number of Agencies, Corporations and Government owned Companies have not fully complied with the provisions of Section 21 of the Fiscal Responsibility Act (FRA) 2007. “Agencies are reminded that the FRA 2007 provides that consequent upon laying of summary of budget estimates of Agencies listed in the schedule to the FRA alongside the National Budget by Mr. President. “It is required that details of such budgets are made available to the National Assembly for consideration and passage.  This position was reiterated by the Senior Special Assistant to the President (SSAP) on National Assembly Matters (Senate)”. Accordingly, SGF Mustapha said President Buhari has directed that “Agencies, Corporations and Government owned Companies in the schedule to the FRA 2007 should comply with the provisions of the law. “All submissions (109 copies to the Senate and 360 copies to the House) should be made available to the appropriate Committees of the National Assembly. “Copies should also be made available to the SSAP on National Assembly Matters (Senate and House respectively), not later than Friday, 23rd March, 2018. “All Agencies, Corporations and Government Owned Companies should honour invitations to defend their estimates timeously. Supervising Ministers are enjoined to ensure timely compliance with the content of this Circular”, the statement further noted.

The legislature equally enjoined the state government to constitute farmers/herdsmen committee at both the state and local government levels as provided for in the State Farmers and Herdsmen Prevention and Settlement of Dispute Law and Grazing Reserves Law in the state. The House also called on the state government to direct the State Ministries of Agriculture, Forestry, Environment and Information, to collaborate with a view to sentisitising the general public especially, the farmers and herdsmen on the need to maintain harmonious relationship to forestall clashes among them.
