Two Taraba State local government chairmen yesterday relived how troops aided killer-herdsmen — an allegation made by former Defence Minister Gen. Theophilus Danjuma.

There are troops in the state under “Operation Cat Race”, the military exercise being conducted to end the killings in the Middle Belt.

The army has debunked Gen. Danjuma’s allegation, saying it remains neutral in the farmers-herdsmen’s clashes in which many have died.

Gen. Danjuma’s advice to Nigerians to defend themselves has sparked a huge row.

The Jukun Development Association of Nigeria (JDAN), a socio-cultural organisation of Jukun in Taraba State, Gen. Danjuma’s kinsmen, backed his stand yesterday.

Another senior citizen, Itsekiri High Chief Rita Lori Ogbebor urged the government to protect Nigerians.

JDAN and Chief Ogbebor spoke at news conferences in Lagos.

The council chairmen, who spoke with reporters described Gen Damjuma’s “intervention” as “a way of making the military turn a new leaf”.

The Chairman of Takum Local Government, Shiban Tikari, said the army began “Operation Cat Race” on February 15 without notifying him and others. He reported to Governor Darius Ishaku before the army served the governor a notification letter on March 1.

“The commencement of the Cat Race has caused resumed attacks and killings by Fulani herdsmen. Many more are now displaced,” Tikari said.

Chairman of Ussa Council Rimamsikwe Karma, told reporters that the soldiers were harassing his people, “collecting kitchen knives and cutlasses from them while herdsmen were walking freely with AK-47 riffles, burning homes and killing people without provocation.

“The herdsmen come with machine guns. They are killers; they are not the herdsmen we know -who had lived with us over the years.”

A widow, Mrs Jumai Andeyaba, told reporters that she had left home last Tuesday for a funeral, soldiers broke into her home, harassed her daughters and stole her N150, 000.

Lt.-Col. Ibrahim Babatunde Gambari, the Commanding Officer of Takum Barracks, said he had no authority to react to the allegations.

It was learnt that Ishaku on August 11, 2017 wrote to the National Security Adviser (NSA), requesting that the Commanding Officer of the 93

Battalion, Takum, Lt.-Col. Gambari, be moved from Taraba, for his “disappointing conduct, in spite of huge security challenges in the state.”

The letter, citing a case of collusion, said some herdsmen who attacked communities in Takum and Ussa local government areas on May 6, last year, were later overpowered by security agents and their 224 cows seized and given to Gambari as a ploy for him to track down the culprits.

A Federal High Court in Abuja has fixed April 25 for judgment in the suit by Accord Party (AP) challenging the legitimacy of the attempt by the National Assembly to reorder the schedule of the 2019 general elections released by the Independent National Electoral Commission (INEC).

Justice Ahmed Mohammed gave the date yesterday after entertaining arguments from parties on whether or not the National Assembly possessed the powers to alter the schedule of elections released by INEC or interfere with the constitutionally guaranteed power of the electoral body to fix dates for,and organise elections.

The National Assembly, represented by Joseph Daudu (SAN), urged the court to decline jurisdiction and dismiss the suit. The plaintiff, represented by Wole Olanipekun (SAN), Attorney General of the Federation (AGF) Abubakar Malami (SAN) and INEC, represented by Femi Falana (SAN), urged the court to grant the plaintiff’s reliefs.

In the suit filed on March 7, AP seeks, among others, a declaration that the amendment to the Electoral Act 2010 (introducing a new Clause 25) just passed by the National Assembly, which prescribes the order in which the general elections should take place, has interfered with the power, right and discretion of INEC generally and, in particular, in respect of the schedule or sequence of the 2019 general elections.

It is also praying for an order setting aside Clause 25 of the Electoral Act (Amendment) Bill, 2018; an order of perpetual injunction restraining the President from assenting to the Bill, and an order restraining the National Assembly from passing into law by a two-thirds majority, or any majority at all, the Bill as it has already been passed.

Olanipekun yesterday argued that the issues his client brought for the court’s determination were not novel as similar issues had been resolved before by courts.

He said: “Years back, the National Assembly passed a Bill, whereby they purportedly repealed the Independent Corrupt Practices and other related offences (ICPC) Act, but Justice Egbo Egbo set aside the Bill and there was no appeal against his decision.”

Olanipekun argued that what the National Assembly sought to do with the Bill, particularly in Section 25, is impossible and inapplicable.

He contended that it was impracticable for the National Assembly to dictate the schedule of elections, to INEC without first altering the electoral body’s power to reschedule elections under Section 26(1) of the law.

Olanipekun argued that it was unlawful for the National Assembly to seek to interfere with the unfettered powers handed INEC by the Constitution –  to plan, organise and conduct elections.

Milost Global Inc., a New York private equity firm, yesterday terminated a $1 billion equity and debt deal meant to grant it 60 per cent stake in Unity Bank Plc.

In a statement, the management of Milost said it had analysed all its facts about the deal, and decided to terminate it. It said a letter terminating the transaction was yesterday morning sent to Unity Bank, even as the firm reaffirmed its interest in the Nigerian market.

Unity Bank Plc had, last week dismissed reports that Milost Global Inc. planned to invest $1 billion in the bank.

In a statement, the bank stated that it has not reached any agreement with Milost to warrant such a speculations. The statement, signed by the bank’s Head, Corporate Communications, Matthew Obiazikwor, said: “We categorically dismiss media claims of any such deal and advise the public to disregard any information to the contrary.”

“The bank hereby makes further clarifications regarding its on-going recapitalization programmes to the effect that Unity Bank has not received commitment for investment of $1 billion from Milost. Unity Bank is in talks with a number of potential investors and has not concluded to pave the way for commitment of an investment,” he said.

But Milost Global Inc gave more details of the transaction. It disclosed that on August 7, 2017 it had received a request for a call with the Chief Executive Officer (CEO) and Chief Finance Officer of Unity Bank Plc.

“On the call, Unity Bank expressed its interest in working with Milost Global Inc. as its funding partner for its growth plans in Nigeria. Following the call, a desk top due diligence was conducted by Milost to its satisfaction. On September 4, 2017 a $1 billion financing term sheet was fully executed by both Milost and Unity Bank. The facility, a combo of equity and debt, was provided on the exciting understanding that Unity Bank would delist on the Nigerian Stock Exchange and move its listing to the USA. The signed term sheet was approved by the board of Unity Bank,” the firm explained.

Continuing, it said that On Monday October 23, 2017, Milost Global Inc. was visited by Mrs. Oluwatomi Somefun, the CEO of Unity Bank Plc,  at its New York offices.

The meeting which went ahead as planned was attended by Milost Global Inc. analysts and the Chairman, Egerton Forster. At the meeting she explained the need for capital funding at the bank and also their expansion plans.

It was then agreed that Milost Global Inc. would start further due diligence on Unity Bank Plc. Further due diligence process started on the same week on the instruction of the Chairman of Milost Global Inc., Egerton Forster. The statement stated that further due diligence was satisfactory and Milost issued a binding commitment agreement to Unity Bank, which was approved by the board of Unity Bank and executed by both parties on November 14, 2017.

More evidence of corrupt practices by ex-President Goodluck Jonathan’s administration may be tendered following a challenge by the former leader, it was learnt yesterday.

Federal Government sources said although there was no immediate plan to arrest or quiz the former President, the government had not ruled out the option.

Vice-President Yemi Osinbajo last week said N150 billion was withdrawn by the Jonathan administration two weeks before the 2015 election.

A fact-sheet by the Presidency revealed how some funds were illegally transported from the Central Bank of Nigeria (CBN) to the private residence of the former President.

A former National Security Adviser (NSA) personally supervised the physical transfer of the money from the CBN vaults to the private residence of the former President.

The document said: “In one particular instance, over N70 billion was released in parts from the national treasury between January 8 and February 25, 2015. The over $289m, which was also referenced last week by the Vice-President, is said to be included in this particular series of illegal transactions.

“Besides that, in another illegal disbursement, the minutes of the Central Bank board meeting of 25th August 2014 indicated the board endorsed another N60billion requested by the former President and released by the apex bank.

“The sum which was okayed by the CBN board, was not tied to any project or procurement, and was meant and disbursed purely for campaign purposes, through the office of the then NSA and the DSS leadership at the time.

“Specifically that N60billion that was okayed by the CBN on August 25, 2014 was said to have been shared between the two security agencies thus: N40billion went to the NSA while N20 billion was released to the State Security Services (SSS).”

A top government source, who spoke in confidence, said: “The Federal Government will release more evidence of looted funds either approved or traced to ex-President Jonathan if he continues to play to the gallery. The government is not out to persecute Jonathan  but it may be compelled to lay the facts bare before the public.
