Dasuki’s family asks NBA to probe Malami

Family of detained former National Security Adviser, NSA, Col. Sambo Dasuki (retd), has lodged a petition against Attorney-General of Federation and Minister of Justice, Mr. Abubakar Malami, SAN, asking Nigerian Bar Association, NBA, to investigate and sanction him for unprofessional conduct.

The AGF was, in the petition signed by Dasuki’s wife, Hajia Bintu Sambo Dasuki; his son, Abubakar Atiku, and his nephew, Senator Umar Dahiru, alleged to have engaged in conducts capable of causing anarchy in the country, by encouraging the Federal Government to disobey lawful court orders directing release of the ex-NSA on bail.

They alleged that Malami had in a media interview, made unprofessional remarks to the effect that the Federal Government would never comply with six separate court orders that gave Dasuki bail, pending his trial. Malami had in the said interview, reportedly maintained that Dasuki’s continued detention since December 29, 2015, was justified, insisting that his action while in office as NSA led to the death of so many people. However, Dasuki’s family contended that such remark was unbecoming for the AGF, who is the Chief Law Officer of the Federation. They wondered why Malami, being a lawyer, would make unguided utterances capable of promoting disobedience to lawful court orders.

Dasuki’s family prayed NBA to invoke the code of ethics on Malami, investigate him and impose deserved disciplinary sanctions against him to safeguard the rule of law for the country. According to the petitioners, Malami’s statement was prejudiced, unwarranted and unbecoming of a legal practitioner. Besides, they urged the NBA to intervene in the ordeal being faced by the ex-NSA, take decisions and actions that would compel FG to respect the rule of law and obey all the subsisting court orders. In the petition copied to Chief Justice of Nigeria, CJN; Legal Practitioners Privileges Committee, LPPC, and Legal Practitioners Disciplinary Committee, LPDC, the family regretted that Dasuki had been unjustly detained without a lawful order for almost three years by the Federal Government.

Before the latest judgment by Justice Ijeoma Ojukwu of a Federal High Court, Abuja on his fundamental human rights, Dasuki had previously perfected bails granted him by four different judges of high courts including Justices Ademola Adeniyi and Justice Ahmed Mohammed of the Federal High Court, Abuja and Justice Hussein Baba-Yusuf and Peter Affen of the FCT High courts. The ECOWAS Court of Justice also ordered his immediate release from detention. Meanwhile, an Abuja-based lawyer, Mr JohnMary Jideobi, has asked Abuja Division of the Federal High Court to void Malami’s SAN rank. Malami was cited as the sole defendant in the suit marked FHC/ABJ/CS/807/2018. Specifically, the plaintiff is praying the court to determine, “Whether upon a community reading and complete understanding of Sections 1(1), 150 (1) and 287(3) of the amended 1999 Constitution of the Federal Republic of Nigeria read alongside Rule 1 of the Rules of Professional Conduct for Legal Practitioners 2007, the Defendant is not bound to exercise the powers of his office and discharge his functions thereunder ONLY in accordance with the provisions of the Constitution of the Federal Republic of Nigeria 1999 as amended?

“Whether upon a community reading and complete understanding of Sections 1(1), 150 (1) and 287(3) of the amended 1999 Constitution read alongside Rule 1 of the Rules of Professional Conduct for Legal Practitioners 2007, the Defendant has not violated his oath of office as Senior Advocate of Nigeria and failed in his duty as a Legal Practitioner [more so the Chief Law Officer of the Federation] by defending the refusal of the Federal Government of Nigeria to obey six valid Court Orders directing it to release a former National Security Adviser [Rtd. Colonel Dasuki] having been admitted to bail and met all the conditions attached to the said bails.

Boko Haram kill 11 solders as troops down 16 insurgents

Boko Haram fighters have reportedly killed 11 soldiers and seized weapons in a raid on a military post in an attack in northeast Nigeria, residents and a military source said yesterday.

This came as military authorities said troops of Operation Lafiya Dole deployed in Forward Operational Base,FOB, along Mairari in Monguno, Local Government Area of Borno State, Friday, killed 16 Boko Haram insurgents. Gunmen in five trucks and on motorcycles stormed the checkpoint in Bunari village near the garrison town of Monguno in Borno State late Friday, leading to a fierce battle.

“They came around 6:30 pm (1930 GMT) and attacked the military checkpoint and soldiers responded with fire,” resident Amadu Sheriff told AFP. “The attackers overpowered the soldiers who took up positions in the trenches dug round the checkpoint from where they fought the Boko Haram gunmen,” he said. Three civilians, including a woman and her child, from a nearby settlement, were killed by stray bullets, he said.

He said residents of the nearby settlement evacuated on Saturday and moved to Monguno for fear of renewed attacks. Sheriff had no idea of military casualties but saw “two ambulances carrying dead soldiers” being taken to Monguno, eight kilometres (five miles) away. A military source who confirmed the attack said 11 troops were killed. “Four (military) vehicles including an APC (armoured personnel carrier) and a gun truck were carted away by the terrorists,” said the military source who asked not to be identified because he was not authorised to speak on the incident.

The attackers were repelled with the help of reinforcements from Monguno, he added. News of the attack was slow to emerge due to poor communication in the area where Boko Haram has destroyed telecoms infrastructure in the last three years. Meanwhile, according to a statement yesterday, from Colonel Onyema Nwachukwu, Deputy Director, Public Relations, Theatre Command, Operation Lafiya Dole, the killing of the 16 insurgents followed an encounter that occurred at about 6.50 pm on the fateful day, in Mairari, a village in Monguno local council area of Borno State.

“The insurgents in three vehicles, including gun trucks had infiltrated and attacked the community, when troops at the FOB were alerted by locals. The troops supported by the Air Task Force swiftly responded to the attack killing 16 insurgents and capturing two gun trucks abandoned by the insurgents, as they tried escaping, having been overwhelmed by the superior fire power from the troops,” the statement said.
